The first thing you should do is immediately seek medical attention for your injuries. It is possible that you have internal injuries also. So, make sure to notify medical personnel of all your pain complaints (even if to you they seem insignificant). Next, notify your boss or employer that you were injured and do so right away and within 30 days of your injury date to be eligible to receive Workers’ Compensation in New York.

Workers’ Compensation provides benefits to injured employees. Typically, people receive a percentage of their lost wages, medical payment reimbursements and reimbursements for travel to medically necessary related appointments.

In New York, Workers’ Compensation is considered an exclusive remedy for an employee. What that means is that usually an employee will not be successful suing his employer.

Sometimes, an employee can sue their boss, a co-worker, a product manufacturer or a third party for their injuries, pain and suffering and future loss of earning capacity. It is important to contact a lawyer if you have been seriously injured at work as you may have more rights than you think.
