What does Statute of Limitations mean?

Think of statute of limitations as an expiration date.

This is just legal language that means your personal injury claim will expire or run out if you do not bring a lawsuit against the person or people responsible for your personal injuries in a certain amount of time.

If you wait too long to bring your personal injury claim, you will be prevented from doing so and will not be able to recover anything in a lawsuit. Also, the insurance carrier will likely not pay your claim either.

What are the Statute of Limitations in New York for a personal injury?

All personal injuries in New York have statute of limitations (or expiration dates) and are classified depending on how the injury occurred.

An auto or car accident is usually 3 years from the date of the injuries to bring a lawsuit.*

A personal injury from a medical malpractice has 2.5 years from the date of the injury.*

Other types of injuries have 3 years such as general negligence cases. This would include falling in a store, suffering an injury at someone’s house or being injured by someone’s pet such as a dog bite.*
