Under New York Law, after an accident all vehicles must stop at the scene and notify the police. If the cars are located in a dangerous position then they can be moved to a safe place. If someone is injured, then call 911 immediately and both the police and ambulance will come.

All driver’s involved in the accident must exchange their name, address, insurance carrier and  policy number. It is recommended that you copy down all of the information directly from the other  driver’s license, including their driver id number. Also, make note of any passengers involved. When the police arrive, make sure to get the officer’s name, badge number and precinct information.

Do not make statements to the other driver regarding the cause of the accident as it is not necessary and could be detrimental to your potential case in the future. When speaking with police, simply state your version of what happened.

If there are any witnesses, make sure to get their name, address and phone number.

If you or one of your passengers are injured, make sure to immediately get treatment at a hospital or primary care physician. It is critical to inform the treating physicians all of the pain symptoms even if they seem unimportant, as there could be internal injuries.

You must notify your insurance carrier regarding the accident right away or you run the risk of them refusing to cover any of the claims.
